SOULCATCHER collects information about you and/or personal data (referred to below as “Personal Data”) via the SINISTER web shop(s) and website(s) (www.sinister.nl and its subdomains), via special offers and other channels. SOULCATCHER is committed to the protection of your Personal Data.

SOULCATCHER is the Data Controller, in the legal sense, for the processing of all Personal Data that is obtained via the aforementioned shops, websites, etc.

“SOULCATCHER” includes SINISTER, PENOZE and other brands by SOULCATCHER.

We want our services to be transparent, personal, and reliable. It is important to us that you know what Personal Data SOULCATCHER collects and the purposes for which we use these Personal Data. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
Personal Data is collected, used, and deleted with all due care and in accordance with the applicable legislation.

Purpose of collecting and processing your Personal Data

SOULCATCHER collects and processes Personal Data for the following purposes:

  1. To fulfill orders placed via the web shop and to create and maintain the relevant user’s personal SOULCATCHER account;
  2. To send offers and news via e-mail, social media, and regular post;
  3. To prepare analyses for process improvement, product and services development, and market research;
  4. To support communication and campaigns via social media;
  5. To address complaints and respond to inquiries.

1. Fulfilling orders placed via the website(s), web shop(s), and SOULCATCHER Account

SOULCATCHER stores Personal Data during visits to the SINISTER Website, during customer inquiries or orders for products or services, and when creating a SOULCATCHER Account. The information you give us may include your name, address, e-mail address and phone number, financial and credit card information, and order history.

SOULCATCHER Account

In order to use all of the services and functionalities that SOULCATCHER offers via the SINISTER website, you must create a personal SOULCATCHER account (referred to below as “SOULCATCHER Account”). When you create a SOULCATCHER Account, you will be asked to provide certain Personal Data.

2. To send offers, news, and special offers via e-mail, post or social media

If you have given your consent, your e-mail address will be used to send you newsletters with offers and information about (for example) our products and services. You can always revoke your consent to be sent newsletters by e-mail by clicking on the unsubscribe link in the e-mails you receive.

SOULCATCHER may also send you offers, specific special offers, and information about (for example) new products and services by regular post. You can also unsubscribe to this service via SOULCATCHER customer cervices, see the bottom of this Privacy Policy.

3. Analysis for process improvement, product and services development, and market research

SOULCATCHER strives to ensure that it provides its websites and services of the highest quality and to tailor its information and product range as closely as possible to the wishes and needs of our customers and visitors.
This requires SOULCATCHER to perform static research so that it can make improvements where necessary. SOULCATCHER may use customer information for this static research. The research results will only be reported as aggregate data, being reported in a form that makes it impossible to trace the identity of individual customers.

4. To support online marketing communication and campaigns

SOULCATCHER is happy to communicate with customers, website visitors, and account members about its company, products, and services via the Web and our own social media channels. We aim to offer useful and relevant information and/or answer questions.

For that purpose, SOULCATCHER may use analytical and tracking tools such as Google Analytics, which collects data from anonymized IP addresses to learn about the number of visitors to our website, page visits, locations, which browsers or types of devices are being used, etc. In order to do this, we use cookies. You will be prompted to accept or decline our cookies in your first visit to our website. Please refer to our cookie policy to learn more.

SOULCATCHER also actively follows the Internet and social media channels, such as Facebook, Instagram or blogs, where we may participate in discussions and answer relevant individual questions. SOULCATCHER expressly reserves the right to refrain from responding to every question or comment. No rights whatsoever may be derived from any of our responses, substantive or otherwise. SOULCATCHER cannot be made responsible for personal opinions or comments published by customers or visitors.

SOULCATCHER may use the access to social media permitted by visitors or customers, such as Facebook, as a result of which SOULCATCHER has access to part of your data on social media. In order to show you more personalized ads when visiting social media (such as Facebook), search engines (such as Google) or other websites and apps, we may use your IP or email address, or other identifying data to match this with data from those social media or search engines. This is always done in a coded and anonymized form. In case you do not agree to this form of advertising you can unsubscribe via email (see bottom of document).

If you communicate with us via our social media channels (for example, when you post a comment, follow us, or “Like” us), we may be able to see Personal Data about you. This Privacy Policy thus applies to the Personal Data that SOULCATCHER processes in such cases. If you choose to share the SINISTER Website(s) or other SOULCATCHER services (including online services) via social media, some of your Personal Data may also be visible to all visitors of your personal social media pages. The conditions and privacy policy of the relevant social media websites apply to the use of those websites.

5. Addressing complaints and responding to inquiries.

If you contact SOULCATCHER because you have questions or complaints about SOULCATCHER’s products or services, we will save your contact information and your question or complaint. SOULCATCHER may ask you to provide Personal Data if we consider it necessary to answering your question or settling your complaint. The Personal Data provided will be used to answer the question or settle the complaint.

  • Other personal data that you actively provide, for example by creating a profile on this website, in correspondence and by telephone
  • Information about your surfing behavior across different websites
  • Internet browser and device type
  • Bank account number

About sensitive data

SOULCATCHER does not intend to collect any sensitive data and our website(s), web shop(s), products and services are addressed to persons of age above 16.

However, we cannot check if a visitor is older than 16. That is why we encourage parents to be involved in the online activities of their children, in order to prevent data about children being collected without parental consent.

If you are convinced that we have collected personal information about a minor without this consent, please contact us through info@sinister.nl, we will then delete this information.

Rights to access and change your Personal Data

You have rights to view, access, cancel, modify, and object to your data at any time. To do so, please contact SOULCATCHER. In such cases, in order to prevent abuse, we will send copies of your data only to your already known e-mail address. In the event that you wish to receive the data at another e-mail address or for example by post, we will ask you to identify yourself.

You can submit this request in written form via SOULCATCHER Customer Service, see bottom of this document. You also have the right to oppose, without motivation or incurring a cost, the processing of your Personal Data for direct marketing purposes.

To unsubscribe from our newsletters, you can opt out any time by clicking the “unsubscribe” button at the bottom of the newsletter.

Complaints related to the use of your personal data may be addressed with the national supervisory authority, the Dutch Data Protection Authority (link).

Which third parties have access to your data?

SOULCATCHER engages third parties during the performance of its services. These may be third parties that SOULCATCHER engages for the performance of marketing activities (such as printers, or e-mail and post handlers), for products and services regarding which SOULCATCHER acts as an intermediary, and for its customer service.

Personal Data will only be made available to third parties if this is necessary for the third party’s performance of the relevant work. To the extent such third parties process Personal Data when performing the relevant services, they do so in their capacity as a Data Processor for SOULCATCHER, and SOULCATCHER has taken the required technical and organizational measures to ensure that your data is processed exclusively for the purposes described above.

Specifically, we use JVH.nl’s web hosting, newsletter and e-mail services. This means that data is stored on servers that are managed by JVH.nl. They do not use this information for their own purposes, but can collect meta data about the use of the services. These are not personal data. Movenext.nl has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data.

Only if SOULCATCHER is obliged by law to do so will it provide Personal Data to regulatory authorities, tax authorities, and investigative agencies. In this context, Personal Data may also be forwarded to recipients in countries outside the European Economic Area. In such cases, SOULCATCHER will take all measures reasonably necessary to ensure that your data is protected as well as possible.

How long will we keep your Personal Data?

The different categories of Personal Data will be stored no longer than is necessary for the purpose they were obtained for, including compliance with legal and fiscal obligations.

For example, Personal Data used for order compliance and delivery will be stored during 7 years (required for legal compliance) plus a maximum of 1 year for removal of your data.

Security of Personal Data

Effective security of Personal Data is a top priority for SOULCATCHER. SOULCATCHER has therefore taken the necessary technical and organizational measures to secure your Personal Data against loss or any form of unlawful usage.

For example, SOULCATCHER always uses a secure SSL encryption or other safe connection during the ordering process and the sending of contact information forms, and makes use of strong security software in the form of Wordfence. In addition, regular backups are made to prevent loss of data.

If we have given you (or where you have chosen) a password which enables you to access certain parts of SOULCATCHER’s site, you are responsible for keeping this password confidential and you should not share this password with anyone.

Unfortunately the transmission of information via the internet is not completely secure. Although SOULCATCHER will do its best to protect your Personal Data, SOULCATCHER cannot guarantee the security of your Personal Data transmitted to SINISTER’s website and any transmission is at your own risk.

Data leak procedures

If we have a data breach, having the website hacked for example, then we will get started as quick as possible. First of all, our administrator of the website and the hosting is informed to see where the data breach is coming from and to see how this can be resolved as quickly as possible. If this concerns personal data with a chance of serious adverse consequences then the leak will be reported to the authority of personal data. Of course, the leak is also reported to those involved.

If there is a data leak, we will keep all the proof of this. This includes anything from the cause of the leak to the solution to close the leak again. We store this data for at least 1 year.

SOULCATCHER and third-party websites

You will find links to other websites on the SOULCATCHER website. SOULCATCHER is not responsible for these parties’ handling of Personal Data nor for the information published in these websites. For more information, read the privacy Policy of the third-party website in question.
